“Research and Technological Institute of the Pipe Industry named after Ya.Yu. Osada” should refute the unreliable information regarding “Turboatom” and also pay the plant compensation for non-pecuniary damage. This decision was made by the Central Economic Court of Appeal.
We recall that on February 28, 2018 the Economic Court of the Dnipropetrovsk region satisfied the claim of JSC “Turboatom” to the Pipe Industry Institute for the protection of business reputation.
In particular, the court acknowledged that the speech of the director of the Pipe Institute Radomir Korol at the conference he initiated, which was publicized on the Internet on the Interfax-Ukraine website and on the “Economy Today” website on the fact that “Turboatom” purchases welded pipes for the manufacture of equipment for turbine capacitors of nuclear power plants of the state-owned enterprise “NNEGCU Energoatom” from a foreign manufacturer more expensive than their market value, does not correspond to reality.
The Central Economic Court of Appeal, which verified the legality of the decision of the court of first instance, by its ruling of March 21, 2019, established that the Institute of the Pipe Industry represented by its head Radomir Korol did not admit the truthfulness and accuracy of the disseminated information, thus violating the professional ethics of respect for “Turboatom’s” business reputation.
Now the management of the Institute is obliged within a month to refute the false information in the same way as it was distributed, and also to pay “Turboatom” 1.00 UAH in compensation for non-pecuniary damage.
