In June 2020, the Kharkiv Regional Administrative Court satisfied the claim of JSC “Turboatom” against the North-East Office of the State Auditing Service to remit the requirement and declare the actions unlawful.
In particular, the court remitted the requirement of the North-East Office of the State Auditing Service of Ukraine under ref. No. 20-05-25/573 dated 30.01.2020 on the elimination of the identified violations, for the period of the enterprise's activity from 01.01.2018 to 01.09.2019 for a total amount of 1 131 756,43 UAH.
On November 12, 2020, the Second Administrative Court of Appeal upheld the position of the first instance court on this requirement, checking the legality of the decision of the first instance court. The Administrative Court confirmed by its ruling that the drawing up of the certificate of audit by the supervisory authority has no legal consequences for the supervised institution, as well as the position of the first instance court to cancel the supervisory authority's requirement to eliminate violations.
